China ’s marriage law provides for the prohibition of domestic violence, but the law does not explicitly state that cold violence is domestic violence. Therefore, the occurrence of cold violence between husband and wife does not violate the provisions of the marriage law.
Article 2 Domestic violence referred to in this law refers to physical, mental and other infringements committed by family members by means of beating, binding, mutilation, restriction of personal freedom, and frequent abuse and intimidation.
Regarding legal evidence, the Civil Procedure Law stipulates seven types of evidence, including documentary evidence, physical evidence, audiovisual materials, witness testimony, statements by parties, appraisal conclusions and investigation records. Victims can collect evidence in the following ways:
If there is a situation of domestic cold violence, you can first seek mediation from the neighborhood committee. If the mediation fails, you will report to the police. The police records, inquiry transcripts, and mediation documents can be used as relevant evidence.
Marriage law in our country prohibits domestic violence, but the law does not clearly stipulate that cold violence is domestic violence. Therefore, the occurrence of cold violence between husband and wife does not violate the provisions of the marriage law.
