Administrative Measures for the Examination and Approval of Foreigners’ Permanent Residence in China

1. These measures are formulated in accordance with the relevant provisions of the law of the people’s Republic of China on the administration of the entry and exit of aliens and the detailed rules for its implementation, with a view to regulating the administration of the examination and approval of foreigners’ permanent residence in China.

2. Permanent residence of an alien in China means that the period of residence of an alien in China is unlimited.

3. The permanent residence permit for foreigners is the legal identity document for foreigners who have obtained the qualification of permanent residence in China to stay in China and can be used alone.

4. Aliens who have obtained the qualification of permanent residence in China shall enter or leave China with valid passports and alien permanent residence cards.

5. The public security organ of the people’s Government of a city divided into districts and the public security branch or county bureau of a municipality directly under the central government shall be the organ to accept the application for permanent residence of foreigners in China; the public security department or bureau of each province, autonomous region or municipality directly under the central government shall be the organ to examine and approve the application for permanent residence of foreigners in China shall be the Ministry of public security.

6. Aliens applying for permanent residence in China shall abide by Chinese laws, be in good health, have no criminal record and meet one of the following conditions:

(1) direct investment in China, stable investment for three consecutive years and good tax payment record;

(2) having held the post of deputy general manager, deputy factory director or above in China, or having the title of associate professor, associate researcher or above and enjoying the same treatment, having been in China for four consecutive years or more and having a good tax record for not less than three years in total;

(3) having made significant and outstanding contributions to China and special needs of the state;

(4) the spouses of the persons referred to in Items 1, 2 and 3 of this paragraph and their unmarried children under the age of 18;

(5) the spouse of a Chinese citizen or an alien who has obtained the qualification of permanent residence in China, whose marriage relationship has lasted for at least five years, who has resided in China for at least five consecutive years, who has resided in China for at least nine months each year, and who has stable life security and residence;

(6) unmarried children under the age of 18 who have joined their parents;

(7) those who do not have immediate family members abroad, who have joined their immediate family members in China, who have reached the age of 60, have resided in China for five consecutive years, have resided in China for at least nine months each year, and have stable living security and residence.

The term referred to in this article refers to the consecutive term before the date of application.

7. The registered capital actually paid by a foreigner referred to in paragraph 1, paragraph 1, Article 6 of these measures for investment in China shall meet one of the following conditions:

(1) the total amount of investment in the industries encouraged in the catalogue for the guidance of foreign investment industries promulgated by the state is more than 500000 US dollars;

(2) investing more than half a million US dollars in the western regions of China and the key counties for poverty alleviation and development;

(3) investing more than US $1 million in Central China;

4. The total investment in China is more than US $2 million.

8. For foreigners referred to in Item 2, paragraph 1, Article 6 of these measures, their employment units shall meet one of the following conditions:

(1) the departments under the State Council or the institutions subordinate to the people’s governments at the provincial level;

(2) key institutions of higher learning;

(3) enterprises and institutions that carry out key state projects or major scientific research projects;

(4) high and new technology enterprises, encouraged foreign-invested enterprises, foreign-invested advanced technology enterprises or foreign-invested product export enterprises.

9. When applying, the applicant shall truthfully fill in the application form for permanent residence of foreigners in China and submit the following materials:

(1) valid foreign passports or certificates that can replace passports;

(2) a health certificate issued by a health and quarantine department designated by the Chinese government or a foreign health and medical institution certified by a Chinese embassy or consulate abroad;

(3) the certificate of no criminal record abroad certified by the Chinese embassy or consulate abroad;

(4) four recent two inch color photos with bareheaded front;

(5) other relevant materials specified in these measures.

10. The approval certificate, registration certificate, joint annual inspection certificate, capital verification report and individual tax payment certificate of the foreign-invested enterprise shall also be submitted when applying for the personnel referred to in paragraph 1, Article 6 of these measures.

The encouraged foreign-invested enterprises shall also submit the confirmation of the foreign investment projects encouraged by the state for development.

11. The following materials shall also be submitted when applying for the personnel referred to in Item 2, paragraph 1, Article 6 of these measures:

(1) the certificate of his / her position or title issued by the employer;

(2) foreign expert certificate or foreign employment certificate;

(3) the registration certificate, annual inspection certificate and individual tax payment certificate of the holding company; if the holding company is a foreign-invested enterprise, the approval certificate and joint annual inspection certificate of the foreign-invested enterprise shall also be submitted;

(4) the project certification documents issued by the competent departments of the provincial and ministerial governments shall be submitted to the personnel in the enterprises and institutions that carry out the key projects or major scientific research projects of the state; the certificate of the high-tech enterprise shall be submitted to the personnel in the high-tech enterprises; the certificate of the high-tech enterprise shall be submitted to the encouraged enterprises with foreign investment, advanced technology enterprises with foreign investment or export enterprises with foreign investment products The personnel holding the post in the company shall submit the confirmation of foreign investment projects encouraged by the state or the confirmation of foreign investment in advanced technology enterprises or the confirmation of foreign investment in product export enterprises.

12. The recommendation letter and relevant certificates issued by the competent department of the Chinese government shall also be submitted when applying for the personnel referred to in Item 3, paragraph 1, Article 6 of these measures.

13. In the application of the personnel referred to in Item 4, paragraph 1, Article 6 of these measures, if they are spouses, they shall also submit marriage certificate; if they are unmarried children under the age of 18, they shall also submit their birth certificate or parent-child relationship certificate; if they are adoptive, they shall also submit their adoption certificate. The above certificates issued by the relevant foreign agencies shall be authenticated by the Chinese embassy or consulate in the country.

14. When applying, the person referred to in Item 5, paragraph 1, Article 6 of these Measures shall also submit the permanent residence certificate of his / her Chinese spouse or the alien permanent residence certificate of his / her foreign spouse, marriage certificate, notarized life security certificate and house lease or property right certificate. The above certificates issued by the relevant foreign agencies shall be authenticated by the Chinese embassy or consulate in the country.

15. When applying, the person referred to in Item 6, paragraph 1 of Article 6 of these Measures shall also submit the certificate of permanent residence of his / her Chinese parents or the alien permanent residence certificate of his / her foreign parents, his / her birth certificate or the certificate of his / her parent-child relationship; if he / she is an adoptive relationship, he / she shall also submit the adoption certificate. The above certificates issued by the relevant foreign agencies shall be authenticated by the Chinese embassy or consulate in the country.

16. When applying, the personnel referred to in Item 7, paragraph 1, Article 6 of these Measures shall also submit the certificate of permanent residence of Chinese citizens or foreigner’s permanent residence certificate, notarized proof of kinship, proof of no direct kinship abroad, notarized proof of economic source of the investor or proof of economic guarantee of the investor, notarized proof of investment. The house lease or property right certificate of the relying person or the invested person. The above certificates issued by the relevant foreign agencies shall be authenticated by the Chinese embassy or consulate in the country.

17. When an alien applies for permanent residence in China, he or she, or the parents or clients of unmarried children under the age of 18, shall apply to the public security organ of the people’s Government of a city divided into districts or the public security branch or county bureau of a municipality directly under the central government where the main investment or long-term residence is located.

If the principal applies for it, the power of attorney issued by the applicant shall be submitted. The power of attorney issued by the applicant abroad shall be authenticated by the Chinese embassy or consulate in the country.

18. The public security organ shall make a decision of approval or disapproval within six months from the date of accepting the application for permanent residence of foreigners in China.

19. The Ministry of public security shall issue the alien permanent residence permit to foreigners who are approved to stay permanently in China. If the applicant is abroad, the Ministry of public security shall issue the alien permanent residence identity confirmation form. The applicant shall apply for the “d” visa at the Chinese embassy or consulate abroad with the alien permanent residence identity confirmation form. Within 30 days after entering China, the applicant shall submit the application to the public security organ that accepts the application Get permanent residence permit for foreigners.

20. Aliens who have been approved to stay permanently in China shall stay in China for a cumulative period of not less than three months each year. If it is really necessary to stay in China for a total of three months every year, it shall be approved by the public security department or bureau of the province, autonomous region or municipality directly under the central government where the permanent residence is located, but the cumulative residence in China within five years shall not be less than one year.

21. The term of validity of the aliens permanent residence permit shall be five or ten years.

Foreigners under the age of 18 who have been approved to stay permanently in China shall be issued a permanent residence permit for foreigners with a validity period of five years; foreigners over the age of 18 who have been approved to stay permanently in China shall be issued a permanent residence permit for foreigners with a validity period of ten years.

22. In case of expiration of validity, alteration, damage or loss of the alien permanent residence permit, the holder shall apply to the public security organ of the people’s government divided into districts or the public security branch or county bureau of the municipality directly under the central government for renewal or reissue. If the public security organ, upon examination and verification, does not lose the prescribed conditions for permanent residence in China, it shall renew or reissue the certificate within one month.

23. An alien holding the alien permanent residence permit shall apply for renewal within one month before the expiry of the certificate; if the contents of the certificate are changed, an application for renewal shall be made within one month after the change of circumstances; if the certificate is damaged or lost, an application for renewal or reissue shall be made in a timely manner.

24. Under any of the following circumstances, the Ministry of public security may cancel the alien’s permanent residence qualification in China, confiscate the alien’s permanent residence permit held by him or declare it invalid:

(1) it may cause harm to national security and interests;

(2) being deported by a people’s court;

(3) fraudulently obtaining the qualification of permanent residence in China by providing false materials or other illegal means;

(4) having resided in China for less than three months or for less than one year within five years without approval.

25. Aliens who have been approved for permanent residence in China before the implementation of these Measures shall, within six months from the date of implementation of these measures, go to the public security organ of the people’s Government of the city divided into districts or the public security branch or county bureau of the municipality directly under the central government where the original residence certificate is issued or the long-term residence certificate is issued to renew the alien permanent residence certificate.

26. To apply for permanent residence in China and to issue, renew and reissue the alien permanent residence permit, the relevant charging items and standards shall be implemented in accordance with the provisions of the price and financial authorities under the State Council.

27. The meanings of the following terms in these measures:

(1) “immediate family members” refer to parents (parents of spouses), grandparents (grandparents), adult children who have reached the age of 18 and their spouses, adult grandchildren (grandchildren) who have reached the age of 18 and their spouses;

(2) “above” and “within” include the figure.

28. The Ministry of public security and the Ministry of Foreign Affairs shall be responsible for the interpretation of these measures.

29. These Measures shall come into force as of the date of promulgation.
