How do Malaysians live and work in China for a long time?

If Malaysians want to live and work in China for a long time, they need to apply to the exit Entry Administration of the public security organ of the local people’s government at or above the county level in the place where they intend to stay for foreigners’ residence certificates within 30 days from the date of entry.

The validity period of foreigner’s work residence certificate is 90 days at least and five years at most. Where it is necessary to extend the period of residence, an application shall be filed with the exit Entry Administration of the public security organ of the local people’s government at or above the county level in the place of residence 30 days before the expiration of the period of validity of the residence certificate.

With reference to Article 30 of the law of the people’s Republic of China on the administration of exit and entry, if an alien’s visa indicates that he / she needs to apply for a residence certificate after entering the country, he / she shall, within 30 days from the date of entering the country, apply to the exit and entry administration organ of the public security organ of the local people’s government at or above the county level in the place where he / she intends to stay for a residence certificate for an alien.

To apply for a foreigner’s residence certificate, one shall submit his or her passport or other international travel documents, as well as relevant materials of the application subject, and retain biometric information such as fingerprints. The exit entry administration organ of the public security organ shall, within 15 days from the date of receiving the application materials, conduct examination and make a decision on examination, and issue residence certificates of foreigners of corresponding categories and periods according to the reasons for residence.

The minimum period of validity of foreigners’ working residence permit is 90 days, and the maximum period is five years; the minimum period of validity of non working residence permit is 180 days, and the maximum period is five years.

With reference to Article 32 of the law of the people’s Republic of China on the administration of exit and entry, where an alien residing in the territory of China applies for an extension of his / her residence period, he / she shall, 30 days before the expiration of the valid period of his / her residence certificate, file an application with the exit and entry administration organ of the public security organ of the local people’s government at or above the county level in the place of residence, and submit the relevant materials of the application subject matter as required. Upon examination, if the reasons for the extension are reasonable and sufficient, the residence period shall be extended; if the residence period is not extended, the person shall leave the country on schedule.

With reference to Article 31 of the law of the people’s Republic of China on the administration of exit and entry, foreigners shall not issue residence certificates under any of the following circumstances:

(1) the type of visa held belongs to the category where the alien’s residence certificate should not be applied for;

(2) falsifying in the process of application;

(3) failing to provide relevant supporting materials in accordance with regulations;

(4) those who violate the relevant laws and administrative regulations of China and are not suitable to stay in China;

(5) other circumstances in which the issuing authority considers it inappropriate to issue residence certificates for foreigners.

Foreigners who meet the requirements of the state for special talents, investors or who really need to change from staying to staying for humanitarian reasons may apply for alien residence certificates with the approval of the exit Entry Administration of the public security organ of the local people’s government at or above the level of a city divided into districts.

With reference to Article 33 of the law of the people’s Republic of China on the administration of exit and entry, the registration items of aliens’ residence documents include: the name, gender, date of birth, reason for residence, duration of residence, date and place of issuance, passport or other international travel document number, etc.

In case of any change in the registration items of the alien’s residence certificate, the holder of the certificate shall, within 10 days from the date of such change, apply to the exit Entry Administration of the public security organ of the local people’s government at or above the county level in the place of residence for the change.
