Legal provisions for Chinese to marry foreigners

“Several Provisions for Chinese Citizens to Register and Marry with Foreigners.” According to this stipulation, if a Chinese citizen is married to a foreigner (including a foreigner who is resident in China and a temporary foreigner, a foreign Chinese, or an alien who has settled in China), both men and women must jointly go to the province where the Chinese citizen’s household registration is located. The marriage registration authority designated by the people’s government of the autonomous region or municipality directly under the Central Government shall apply for registration. When applying for registration, the parties must hold the following documents:
Chinese citizens: 1. My household registration certificate; 2. My name, gender, date of birth, nationality, and marital status issued by the county-level government, the school, the business, or the enterprise at the county level or the work unit where the household registration is located. (unmarried, divorced, widowed; the same below); the nature of the occupation, the nature of the work, and the application for marriage.
Foreigner: 1. My passport or other identity and nationality certificate; 2. The Alien Residence Permit issued by the public security organ, or the identity document issued by the foreign affairs department, or the temporary entry and residence permit to China; The Ministry of Foreign Affairs (or the authority authorized by the Ministry of Foreign Affairs) and the certificate of marital status issued by the national notary office certified by the Chinese embassy or consulate, or the marital status issued by the embassy or consulate in China.
Foreign nationals: 1. The identity or nationality certificate of the passport or substitute passport (the stateless person is exempted); 2. The Alien Residence Permit issued by the public security organ; 3. The county-level people’s government or the working unit where the household registration is located The certificate of the person’s name, gender, date of birth, marital status, occupation, and application for marriage from the above-mentioned institutions, schools, undertakings, and enterprises at the county level or above.
In addition, both men and women who apply for marriage must also submit a pre-marital health check certificate issued by the hospital designated by the marriage registration authority and photographs of both men and women.
The marriage application with complete documents mentioned above shall be reviewed by the marriage registration authority, meet the marriage conditions stipulated in the Marriage Law of the People’s Republic of China, and the Chinese citizens who are not allowed to marry foreigners in the regulations shall be allowed to marry and shall be handled within one month. Registration procedures are issued and a marriage certificate is issued.
Several regulations for Chinese citizens to register marriage with foreigners
1. Chinese citizens and foreigners (including foreigners stationed in China and temporary foreigners, foreign Chinese, and nationals residing in China) who voluntarily marry in China must be jointly sent to the provinces and autonomous regions where the Chinese citizens are registered. The marriage registration authority designated by the municipal government directly under the Central Government shall apply for registration.
2. Both men and women applying for marriage registration must abide by the relevant provisions of the Marriage Law of the People’s Republic of China and these Provisions.
3. Chinese citizens and foreigners applying for marriage registration must hold the following documents:
A, Chinese citizens:
(1) My household registration certificate;
(2) The name, gender, date of birth, nationality, and marital status of the county-level people’s government or the county-level or higher organs, schools, undertakings, and enterprises that are located in the locality where the household is located (unmarried, divorced, widowed, under Proof of the same, occupation, nature of work, and the application for marriage.
B, foreigners:
(1) My passport or other identity and nationality documents;
(2) The Alien Residence Permit issued by the public security organ, or the identity document issued by the foreign affairs department, or the temporary entry or residence permit issued to China;
(3) Proof of marital status issued by the local notary office certified by the Ministry of Foreign Affairs (or authorized by the Ministry of Foreign Affairs) and the Chinese embassy or consulate in the country; or the marital status certificate issued by the embassy or consulate in China.
C, foreign nationals:
(1) The identity or nationality certificate of the passport or the substitute passport (the stateless person is exempted);
(2) The Alien Residence Permit issued by the public security organ;
(3) The name, gender, date of birth, marital status, occupation, and the certificate of the person who applied for marriage at the county-level government or above, or the school, business or enterprise unit of the county-level people’s government or the unit where the work is located.
In addition, both men and women who apply for marriage must also submit a pre-marital health check certificate issued by the hospital designated by the marriage registration authority.
4. The following Chinese citizens are not allowed to marry foreigners:
(1) Active military personnel, diplomats, public security personnel, confidential personnel and other personnel with major confidentiality;
(2) Those who are receiving reeducation through labor and serving their sentences.
